Appeals Court Overturns Sect Custody Decision

SAN ANGELO, Texas (AP) -- A state appellate court has ruled that child welfare officials had no right to seize more than 400 children living at a polygamist sect's ranch.

The Third Court of Appeals in Austin ruled that the grounds for removing the children were ''legally and factually insufficient'' under Texas law. They did not immediately order the return of the children.

Child welfare officials removed the children on the grounds that the sect pushed underage girls into marriage and sex and trained boys to become future perpetrators.

The appellate court ruled the chaotic hearing held last month did not demonstrate the children were in any immediate danger, the only measure of taking children from their homes without court proceedings.

The fact that many underage girls were pregnant and/or already had babies wasn't enough?

What is wrong with these judges? These teenage girls are being impregnated. Incest is probably occurring. What is wrong with this country for allowing these things to happen.

Ironic of all was that this ruling was made in Texas of all states.

Stereotypically, it seemed odd that such a abominable cult as FLDS, with its incest, child rape, inbreeding, abuse, harassment, etc., would be let of in the most conservative of states.

The statement had no factual support. I expected a much more reasonable decision, especially from TX.

From what I gather from the article they aren't off the hook. What they're saying is that Child Welfare over stepped their boundaries by not bring them to court before seizing the children. I'm sure a trial will no follow and the article does say they aren't releasing the children at this time so I assume they will be held at least till a trial has happened. Even if Texans would prefer to just hit them with a brick and save the children even they must follow the law.
