Producer Bing Accuses Penn of Extortion

LOS ANGELES (AP) - Producer Steve Bing is suing Sean Penn for $15 million, accusing the actor of trying to extort $10 million from him in a dispute over whether Penn would star in a proposed movie titled "Why Men Shouldn't Marry."

According to the lawsuit, Penn appeared to have lost interest in the project but still tried through various means to force Bing to pay.

If the money wasn't paid, the lawsuit indicates, Penn would publicly embarrass Bing by saying a political disagreement between the two had kept him from making the movie.

"Penn's representatives menacingly warned Bing that Penn could not be controlled, and that he was crazy and irrational," the lawsuit stated.

A message left Tuesday for Penn's publicist wasn't immediately returned.

According to the lawsuit, Bing and his company, Shangri-La Entertainment, invested millions of dollars to make the film. Among the efforts Bing made, according to the action, was contracting with Woody Allen to appear in the film and provide script notes for it in exchange for Penn's agreement to drop a demand for script approval before he would commit to the project.

"However, Penn reneged on his promise to waive script approval without reservation, and then insisted that he and Shangri-La had entered into a 'pay or play' contract which Penn wrongly contends requires Shangri-La to pay Penn $10 million whether or not Penn appears in the motion picture," the lawsuit states.

Bing seeks $15 million in general and special damages along with unspecified exemplary and compensatory damages, as well as a court ruling that Penn does not have a "pay or play" contract for the film.

Actor Penn Claims Lost Movie Role Over Iraq Views

LOS ANGELES (Reuters) - Actor Sean Penn is claiming in a lawsuit that he lost a movie role because of his public opposition to a U.S. war against Iraq.

But Movie producer Steve Bing has countered in his own lawsuit that Penn is "irrational and irresponsible" and accused the actor of trying to extort $10 million for a movie he had no deal to star in.

Bing and Penn hit each other with Los Angeles Superior Court lawsuits on Tuesday in a bitter feud over the putative movie, "Why Men Shouldn't Marry," that could result in a classic courtroom showdown.

Penn, the ex-husband of Madonna, accused Bing of "borrowing a page from the dark era of Hollywood blacklisting" by allegedly reneging on a contract for him to play the lead in the movie after Penn aired his views on Iraq in a January television interview.

Bing, most famous for a bitter dispute over paternity of British actress Elizabeth Hurley's child, termed Penn's claim blackmail.

Bing alleged that on Penn's return from Iraq, Penn threatened "to turn their business dispute into a First Amendment crusade" although it had nothing to do with free speech, threatening to tell the media he had been forced off the movie because of his opposition to a U.S. invasion.

Bing said he had never closed a deal with Penn but had spent millions of dollars on pre-production for the movie which he wrote and intends to direct in the belief that the actor would be on board.

Penn claims breach of oral contract and is asking for $10 million in damages. Bing claims civil extortion and is claiming $15 million in damages.

Bing co-wrote KANGAROO JACK, so can I sue him for extorting me out of $4.50?

This is simply another case where people should just chill the hell out. Calm down, settle it over drinks and not in the trades.

didn't bing leave liz hurley a bun in the oven then refused that the child was his then was proved that in fact it was his and refused to pay... then offered to pay ...then was denied by hurley.....


damn i hate to see how this penn things turns out...(trying to be as sarcastic as i can be) cuz if there is one thing you don' t mess with is a mans money..that and him making shitty movies.. ...

i think they made kangaroo jack cuz of the money behind it and even they were surprised it was hit.. haha

Mr. Penn is making too big a deal. If the director doesn't want to cast him, he doesn't want to cast him. Plus, he's a terrible director. What's the big fucking deal?

But yeah, I agree. I think Penn may be taking this one a little too far. Plus, I doubt it could withstand a trial.
