'Party of Five' star charged here with child rape

EVERETT - A one-time Mukilteo resident who starred in the television show "Party of Five" was charged with second-degree child rape today, according to documents filed in Snohomish County Superior Court.

Scott Hamilton Bairstow, 33, allegedly had sex with a 12-year-old girl sometime between January and October 1998 while he was living in Mukilteo with his wife and son. The sexual relationship continued until the summer of 2001, according to charging papers.

Earlier this year, Bairstow, who lives in Los Angeles, allegedly called the girl to engage in phone sex. Charging documents say he repeatedly told the girl that if she told anyone he would lose his family.

The girl, now 17, told her family about the relationship last month. This month, Mukilteo Police had the girl stage a telephone conversation with Bairstow, which police tape-recorded.

In addition to appearing in television shows, Bairstow also appeared in several films, including "The Postman," with Kevin Costner, and "White Fang II: Myth of the White Wolf." He was in Seattle in 1998 for production of the film "Delivered."

This is very surprising, he didn't seem like the kind of actor to be involved in something like this, rather sick, and even continued till the girl was 15. And for a father with two kids, one which would have been 3 when this happened, and another which was born in October 1998, when this happened, it makes the situation even worse. And its a shame he got away with it for so long, but at least its known, and can be stopped...

I found some information on Alaskan law, Quoth. It's probably not exactly the same in his state, but very similar.

The Alaska Statute (AS) which addresses statutory rape, or sexual abuse of a minor, in the second degree (AS) 11.41.436(a) (1) being 16 years of age or older, engages in sexual penetration with a person who is 13, 14, or 15 years of age and at least three years younger than the offender, or aids, induces, causes or encourages a person who is 13, 14 or 15 years of age and at least three years younger than the offender to engage in sexual penetration with another person;

I cant picture the man you all are speaking of as I haven't seen the films, but I do hope that if he did it (and with a tape Im sure he did) he is convicted.

EVERETT, Wash. -- Hollywood actor and former Mukilteo resident Scott Hamilton Bairstow pleaded not guilty yesterday [Tuesday, 6/3/03] to charges that he had sex with a 12-year-old girl and later asked her to keep quiet about it.

Prosecutors have accused the actor, known for his roles in "Tuck Everlasting" and "Party of Five," of second-degree child rape. They claim he had sex several times from 1998 to 2001 with an underage girl who is related to his wife.

They also allege Bairstow began calling the now-teenage girl again this year to have phone sex, asking her to tell him she was a little girl, according to court documents.

Bairstow -- dressed in ... beige corduroys, a plain shirt, beaded
necklace and a two-week beard -- appeared briefly in Snohomish County Superior Court yesterday to answer those charges. He pleaded not guilty and was released by the judge, who allowed him to leave the state for work and set an Aug. 15 trial date.

The 33-year-old actor has appeared in nine feature films, including
"White Fang 2." His TV roles included appearances in "Touched by an Angel," "Wolf Lake" and "Lonesome Dove: The Series."

His attorney said after the hearing that statements Bairstow made during a recent phone conversation with the girl are being twisted out of context by the prosecution.

The following conversation was recorded by police last month after the girl told her family about the alleged sexual abuse, according to charging documents filed by prosecutors:

Bairstow: OK. Um, I mean, ho...how are you feeling, are ya, are, are you mad?

Girl: Um...I don't know. I think it's affected me in a lot of ways,
but...

Bairstow: It has?

Girl: Yeah. I don't know. I don't really know what to feel, ya know?

Bairstow: Have you told anyone?

Girl: No, but I'm thinking maybe I should.

Bairstow: K, um, why are you thinking that?

Girl: I don't know. I just, I don't know. You don't think I should
tell anyone?

Bairstow: Well...I'm like a dad, and I've got a job, and if you were
to tell anyone, I would be thrown in jail for 10 years.

Girl: Are you serious?

Bairstow: Yeah, yeah, I'm not kidding around...it would destroy my
life.

Mitchell Egers, a Los Angeles attorney representing Bairstow, said further evidence will show that his client is innocent. He also said that conversation will take on an entirely different meaning.

"It was taken out of contest and doesn't have the meaning one would draw from the few sentences that are there," Egers said.

First degree crimes in the US are those that are premeditated. In other words, the person thought about it and planned it out.

I believe second degree rape means the prosecutors are saying he may not have planned the sex in advance.

Unfortunately usually these are not really reflections of the crime so much as what the prosecutors think they can "make stick" in the courtroom. Second degree is easier to convict.

Any law students or attorneys out there who can do a better job of this than me?
