Nick Nolte got a Hulk-size monkey off of his back.

The actor, currently chomping scenery as Bruce Banner's deranged scientist father in The Hulk, has been cleared of violating his probation.

The two-time Oscar nominee, on a short leash since pleading no contest for a driving-under-the-influence rap, was in a Malibu court Friday as Los Angeles Superior Court Judge Mira weighed whether the actor had fallen off the wagon.

Last month, an anonymous tipster phoned prosecutors and said the Affliction star had been spotted in the San Francisco area acting tipsy, buying booze and then getting behind the wheel of a car.

In court Friday, it was determined that Nolte did indeed go into a liquor store, buy $120 worth of booze and drive away.

"But there was no confirmation that he was under the influence," Deputy District Attorney Lorraine Petersen told the judge, adding that people with Nolte after the purchase said he was not drunk.

Mira agreed, saying, "I don't think it's grounds for violation. Why someone would make such a call and report this, I don't know."

Outside court Friday, Nolte explained that he bought the booze for guests at a benefit get-together. The actor, who eschewed his infamous mug shot Hawaiian shirt for a dark blazer and slacks, added, "It was just false allegations."

If true, it would have been a big no-no for Nolte, 62, who, according to prosecutors, was hepped up on the so-called date-rape drug GHB (gamma hydroxybutyrate), took to the wheel of his Mercedes and proceeded to ignore the yellow lines on Malibu's Pacific Coast Highway last September.

Nolte pleaded no contest in December to a DUI charge. He was placed on three years' probation and ordered to undergo counseling and random drug tests. He also completed a stint in rehab.

At the time, Judge Mira warned Nolte to keep clean. "If you violate [your probation]," Mira said, "you're very likely to go to jail."

Nolte, who also apologized in court to prosecutors for mouthing the words "you're going to lose" at an earlier hearing, is due back in court January 20 for a progress report.

In addition to The Hulk, Nolte can also be seen in the indie period drama Northfork, now making the rounds on the art-house circuit.

Ok as someone who is clean and sober I find something here deplorable. The fact that society ie the courts can dictate what a person can do in the privacy of thier own home with a legal substance, meaning as far as I am concerned and I dont care what Nolte has been charged with in the past, he should have every right to go purchase booze from a store and get fucking drunk as hell in the confines of his own home as long as he aint out doing shit in public wacked out.

Sorry I just the think the Los Angeles judical/court system has more important things to deal with then some crazy celeb who wants to buy booze and get toasted at his own house.

Nolte has struck me as a guy who actually has cleaned up his act as of late, so I somewhat believe his story. yet, at the same time....well....who needs 120 bucks worth of booze? To each his own I suppose...
