Woman Sues Spanish Actor Bardem for Broken Nose

NEW YORK (Reuters) - Javier Bardem, star of Oscar-nominated "The Sea Inside," is being sued by a woman who says the Spanish actor hit her in the face while drunk and dancing at a New York nightclub, her lawyer said on Friday.

Attorney Sanford Rubenstein said his client Jill Marshall, a former model, had suffered a broken nose and would require surgery because she still has breathing problems since the incident in the early hours of Dec. 10.

Bardem's attorney Martin Singer said he denied any liability for the woman's injuries. Singer said Marshall had approached the actor to dance with him several times at the nightclub party to celebrate the launch of his new film, but he initially rebuffed her.

"He is an excellent dancer. I'm not going to comment on the woman's dancing abilities. However, to the extent the woman was injured while she was dancing, it was caused by her own conduct," Singer said.

Bardem was at the Manhattan nightclub to celebrate the U.S. launch of his new film, titled "Mar Adentro" in Spanish, in which he plays a quadriplegic determined to win the right to end his life. The film has been nominated for the best foreign language film Oscar.

Marshall is also suing the nightclub Gypsy Tea for negligence in continuing to serve alcohol to Bardem "even while in a state of intoxication" and for failing to provide security to prevent the incident.

The fracas at the club was reported in a gossip column last month in the New York Post, which quoted Marshall as saying it was an accident.

"It was an accident, but he was wildly out of control and when you injure someone, you have to take responsibility. I am in a lot of pain, and I haven't left the house for a week," Marshall was quoted as saying in a comment confirmed by her lawyer as accurate.

Rubenstein said Marshall was seeking unspecified damages for the injury and distress caused. "She believes it's appropriate for a jury to decide what's appropriate for the damages she's suffered," Rubenstein told Reuters.

Might be true, might not be. Bardem looks like a nice guy, but he's Spanish, and he looks as hot-blooded as the stereotypes go, so who knows (on a sidenote, I love the guy -- maybe the best continental European actor alive today, in my opinion, and a real man's man), but I'm skeptical. Cases like this one always yell "beeyatch trying to make some money easy!" in my ears -- call it prejudice, I don't know.

I've heard of this story before. In fact, it was first described as that the guy was dancing a bit wildly and accidentally hit her because his arms were flapping. And now a lawsuit? God, what a cunt.
