The guy who decided to pirate X-Men Origins: Wolverine gets a year in prison

Dec. 19, 2011by: Niki Stephens

Remember that guy who uploaded the unfinished copy of X-MEN ORIGINS: WOLVERINE? Well, they've finally handed him his punishment.

The pirate in question, Gilberto Sanchez admitted back in 2009 that he bought the film on a street corner near his home in the Bronx. In March, Sanchez plead guilty to one count of uploading a copyrighted work being prepared for commercial distribution. He went on to state that he spread the file to Megaupload.com and various other sites. In the prosecutors statements, they spoke of the "damage" that was done in such a short amount of time, "Although Fox was able to get defendant's Wolverine workprint removed from his Megaupload account within approximately one day, by then, the damage was done and the film had proliferated like wildfire throughout the Internet, resulting in up to millions of infringements."

Sanchez was sentenced to one year in federal prison by sentenced by U.S. District Judge Margaret Morrow, who described his actions as "extremely serious."

United States Attorney Andr Birotte Jr. sees this as a warning to all the pirates out there, "The federal prison sentence handed down in this case sends a strong message of deterrence to would-be Internet pirates. The Justice Department will pursue and prosecute persons who seek to steal the intellectual property of this nation."

I think watching Wolverine is a fairly just punishment for pirating Wolverine.

This dude is my hero!

He saved us from spending money on this HORRIBLE piece of crap film. He should get a medal, not jail time. This film still made WAAAAAAYY more money at the box office than it should have.

Bullshit...

"The federal prison sentence handed down in this case sends a strong message..." Yes, that message is our legal system is flawed and can be easily bought...

Yet the person he bought it from didn't get any time? What about the person at FOX who leaked it, what did he get?

Better yet, they want to send a message? Walk down Broadway in NYC and arrest all the bootleggers that have actual shops on the street.

Man.. I feel much better now knowing the FBI are keeping us safe from this dangerous criminal. :)

Now if you'll excuse me, I have to answer the door for some stranger wielding an axe.

Wow

Good idea, let's ruin one more non-violent offender's life by sending him to prison. I don't care if it's only a year, that's 364 days too many. This guy did people a service by saving them the waste of money and time that was Origins.

One more thing

Does anyone remember the other ad, where they had a stunt man complaining about pirated movies? About how it cuts into his pay and hurts the others associated with the production. If I was in fanboy geek court I would site Mr. Pink v. Waitress. Don't ask the customer to help you out, your part of something that serves them (the movie they pay for, or steal). Ask your fucking union why you don't get paid enough, they'll(Studio Fucks) tell you a line of bull shit about pirating or some other

So upsetting. If they wanted to stop pirating, they would have, but it's unstoppable at this point. This isn't the war on drugs, which we lost thank god. Hollywood is so fucking rich and stupid it doesn't surprise me, not to mention the lawyers for such pithy cases. At least they're not playing the "You wouldn't steal a car" anti-piracy ad anymore. I thought it was a bit short sighted to assume criminals to go to movies. I steal everything in that ad before lunch, then I pay to see a

Its not unstoppable, Hollywood is in on it. Give us more content for our money, and it would give us a reason to fork over $30 for a Blu ray I might watch twice. Change the laws...

Current law: If you buy a movie legally and loan or trade it with a friend, your breaking the law. If you make a copy for back up for a legal copy of a game or movie, you broke the law. If you bought a video console and made adjustments to it to play your legal back ups of games or movies, you broke the

What if some executive from the film company originally leaked it. If it caught on and people liked it then that executive would've generated positive buzz about the movie. Unfortunately it was a piece of shit film and most people saw that even though it was unfinished at the time. Now this guy is going to jail because we've got to make the example that if people are going to be entertained they bloody well better be price gouged whilst doing so! Fuck that judge and fuck this cuntry's judicial

Really?

A year of this guy's life for uploading a friggin' movie online? That is insane. IT'S A MOVIE! It's not like he was kicking state secrets up to WikiLeaks. Jesus.

I agree with everyone on here that suggested he was prosecuted so vigorously because they made a crap movie that failed because it was awful. Someone or some people were trying to save their jobs or save face by blaming the film's disappointing box office on "piracy". In truth, the film was a complete mess and people avoided it for

Blame the dude who leaked from the source, but I guess they have NO idea who is it.

What a joke

He wasn't actually the one who leaked it online, though. Scene groups (piracy groups) leaked it! That's where I don't think these courts really understand how piracy works. This guy bought a copy after it had already been distributed, but was probably dumb enough to upload it to a website or something. It's like, yeah, he might have helped spread it around, but go after the people who are really responsible for the initial infringement!

No, what they are doing is arresting drug users and not drug dealers...Also, its the drug makers that are the drug dealers, so you kind of make no sense

I loved X-Men Origins: Wolverine, but it could have been alot better. Like not literally butchering Deadpool into something else entirely.

At first glance I thought the headline said the guy who DIRECTED 'Wolverine' has got a year in prison. Would have been a light sentence.

Devil's advocate, what he did had a serious impact on the movie's box office takes, since the early leak and the bad word of mouth that spread about how terrible the movie really was, caused many to skip it. That's the reason they got so aggressive with this guy. Of course, if they had made a better movie, it wouldn't have been an issue. So, plenty of blame to go around there.

Devil's Other Advocate: If a good movie gets leaked and good word of mouth was spread, based on the recent swiss reports on pirating, wouldn't more money have been made? Thus, wouldn't Fox be less angry?

At the heart of it, Fox is really pissed because a bad movie got released and they got caught on a lie (Since they said that there was a substantial difference between the two) and the feds made a case of it because of those losses.

Really, Fox should have made a better movie and this

Really, Fox should have made a better movie and this guy should get a medal for warding off many from spending money on this turd. Why weren't the original Pirates caught/prosecuted, all he did was upload an ALREADY PIRATED video...

I agree with the second advocate, I mean it's impossible to guage how much money a Wolverine movie with bad reviews would've made without the leak. Did it maybe knock a couple million off the opening box office? Probably. Did it legitimately impact how the film did financially? I doubt it.

Seriously what's the point? Unfortunately, in the internet age we live in, it's just too easy for people to pirate things these days. You just gotta live with it. Besides, they should love this guy. He gave them an excuse on why their incredibly disappointing movie underachieved.

I agree that the film was the worst, but it made $373,062,864 worldwide, so I wouldn't call that underachieving. If anything, that figure should prove that the release of the film on the Internet didn't have THAT big of an impact in the end.
